Notarial intervention ensures safe deals

The German legal system foresees the mandatory intervention of a notary with constitutive effect concerning specific legal acts and transactions in real estate, corporate, succession and family matters. The absence of such notarial intervention may render null and void the act or transaction envisaged by the parties. Hence, from a common law perspective, the term civil law notary is often applied to this specific legal profession.

A German notary acts as an impartial public legal officer and is submitted to a strict code of conduct. Notarial fees are calculated transparently according to federal statutory provisions.

Unlike other parts of Germany, state law ‑ both in Hessen and Berlin ‑ permits lawyers admitted to the bar, to be also appointed as notaries after having completed successfully an assessment and competition process.
